INTRODUCTION
These general terms and conditions of sale (hereinafter the " Terms & Conditions" ) constitute the contractual documents governing the relationship between Leslie Leroy Consulting, a limited liability company incorporated under Moroccan law, trading under the name “LES PETITES EXPERIENCES” (hereinafter referred to as " “), whose ICE number is 003130383000027, RC number is 554127 and patent number is 5785934, whose registered office is located at Résidence Azzarka, 117 rue Ibnou Mounir, 1st floor, appartement n°2, Maarif, 20000 Casablanca, Morocco, and customers booking and/or participating in an experience (hereinafter the ‘CUSTOMER’) in the context of the professional activity of LES PETITES EXPERIENCES, namely the organisation of tourist experiences in Morocco (visits, excursions, workshops, meetings...). LES PETITES EXPERIENCES and the CLIENT are hereinafter referred to individually or collectively as the ‘Party or Parties’.
By accepting these general terms and conditions of sale, the CUSTOMER warrants that he/she is a natural person of legal age or a legal entity (company, association or administration), and that he/she has full legal capacity to place an order.
The CUSTOMER agrees to receive all information concerning the placing of the order and its execution, and more generally concerning the execution of these general terms and conditions, and to receive the invoice by e-mail.
ENTRY INTO FORCE / DURATION
The present general conditions apply without exclusion once the CUSTOMER has paid for himself and/or the persons accompanying him for any visit or service provided by LES PETITES EXPERIENCES. The payment of the order by the CLIENT constitutes an effective reservation, and implies that the CLIENT has read and understood the present general conditions of sale. The CUSTOMER acknowledges that acceptance of these general conditions is effected by tacit agreement at the time of payment for the service by the CUSTOMER, and does not require a handwritten signature.
These general terms and conditions remain in force until all rights and obligations of either party are extinguished.
BOOKING AN EXPERIENCE
The experiences proposed by LES PETITES EXPERIENCES are private. To register, the CUSTOMER must therefore send a request to LES PETITES EXPERIENCES by email to hello@lespetitesexperiences.com, by Whatsapp on +212 (0)6 43 899 535, or via the registration or contact form on the website www.lespetitesexperiences.com.
LES PETITES EXPERIENCES will then contact the CUSTOMER by Whatsapp and/or by email to find out their needs, propose a date, a time slot, confirm the price and give them all the useful information for the smooth running of the experience (meeting place, equipment to bring, etc).
The CLIENT must pay LES PETITES EXPERIENCES for the service in order for the reservation to be confirmed. Payment for the service implies acceptance of the conditions set out by LES PETITES EXPERIENCES during the exchanges with the CLIENT, and of the present general conditions of sale.
The reservation will be validated by LES PETITES EXPERIENCES on receipt of proof of payment or settlement, the latter having to take place before the experience takes place.
The CUSTOMER guarantees LES PETITES EXPERIENCES the veracity of the information communicated at the time of booking, in particular his identity and email address, and undertakes to update the data concerning him so that it is always true.
PRICES AND PAYMENT TERMS
Prices are fixed and include all taxes. On the website www.lespetitesexperiences.com for each experience, the CLIENT will find details of the services included and not included.
LES PETITES EXPERIENCES is a responsible company with ethical principles. The prices of the experiences offered ensure fair remuneration for local partners. The aim is to pay local service providers the right price to ensure that their income is sustainable and in line with the quality of the service provided. We don't cut corners, to ensure that you get the highest quality of service.
Furthermore, the experiences offered by LES PETITES EXPERIENCES are private: the price per person depends on the number of people taking part in the experience. In the event of the cancellation of one or more participant(s), the price for the remaining participants will therefore be recalculated according to the actual number of participants in the experience, and the CLIENT will only be reimbursed for the difference between the amount already paid and the amount due once the price has been recalculated (see paragraph on cancellation policy).
The payment of the Experiences by the CUSTOMER is made only in the currency of his country of origin, by PayPal, by Western Union to the account of LES PETITES EXPERIENCES or at a point of collection. To pay for an experience, the CUSTOMER can also use a ‘ LES PETITES JAMBES / LES PETITES EXPERIENCES ’ gift card. In this case he must inform LES PETITES EXPERIENCES at the time of reservation.
EXPERIENCE PARTICIPATION
The CLIENT understands and confirms that participation is entirely voluntary. The CLIENT assumes responsibility for ensuring that he/she is mentally and physically capable of participating in the experience. The CLIENT agrees that he/she is able and willing to walk for the duration of the experience indicated on the website. www.lespetitesexperiences.com for the experience reserved. If, for medical reasons, the CLIENT is unable to walk and requires a means of transport, subject to availability, an additional fee will be charged by LES PETITES EXPERIENCES for this service.
At all times during the tour, the CLIENT agrees to show consideration for other participants, the guide or tour leader, and other third parties. The CLIENT agrees to follow the instructions in English or French (depending on the language of the experience) of the guide or tour leader leading the experience. If, in the opinion of the latter person, representing LES PETITES EXPERIENCES, the CLIENT's behavior or physical condition is prejudicial to the proper conduct of the experience, constitutes a risk or a nuisance to others, the representative of LES PETITES EXPERIENCES has the right to ask the CLIENT not to participate or to leave the experience during its execution, without this giving the right to any reimbursement of the price of the experience or compensation.
SAFETY, HEALTH AND MEDICAL CONDITIONS
The CLIENT fully understands and accepts all risks associated with his or her participation in the experience, including injury or death resulting from exposure to adverse weather conditions, foodborne illness, allergic reactions, choking, and injuries resulting from accidents inflicted by himself or herself, by other participants, by motor vehicles, by animals... The CLIENT understands that most experiences take place in public places under conditions largely beyond the control of LES PETITES EXPERIENCES. If he wishes to protect himself against these risks, the CLIENT is strongly encouraged to take out travel insurance. (Chapka Assurances, for example).
During certain experiences, LES PETITES EXPERIENCES may subcontract transportation services to an external supplier (organization or person). LES PETITES EXPERIENCES cannot assume any responsibility for accidents, delays, injuries, losses or damages due to any act or omission of these external suppliers, engaged in the transportation of passengers.
All food and beverages consumed by the CLIENT during the Experiences are sourced from third-party establishments (i.e. vendors, cafes, markets and other related food establishments). LES PETITES EXPERIENCES plays no role in the sourcing of ingredients or in the preparation of the food/beverages served. LES PETITES EXPERIENCES takes care to select reputable establishments, but cannot assume any responsibility for any illness or injury caused to the CLIENT while visiting these establishments or as a result of consuming the food and beverages they sell.
For any experience involving the consumption of food and drinks, or the purchase of ingredients on the market and their preparation for a meal, the CLIENT agrees to assume full responsibility for the food consumed and will not hold responsible LES PETITES EXPÉRIENCES, or any of its third-party suppliers/subcontractors, in the case of medical damage. The CLIENT understands, accepts and assumes full responsibility for the potential risks and dangers associated with the consumption of food and beverages during the experiences he has booked.
In case of food restriction, allergy and/or other medical condition related to walking or food/drink, the CLIENT must inform LES PETITES EXPÉRIENCES at the time of booking the experience. While there is no guarantee that LES PETITES EXPÉRIENCES will be able to meet these restrictions, we will do our best to do so. In case of dietary restrictions or allergies, it is imperative that the CLIENT remind his restriction/allergy to the guide or experience companion before consuming food/beverages, so that the representative of LES PETITES EXPÉRIENCES can check with the establishment providing the ingredients. In case of allergies or medical restrictions reported after the actual booking of an experience, the price of the experience will be refunded according to the standard cancellation conditions.
While we do our best to ensure that any allergies communicated to us are properly managed, LES PETITES EXPÉRIENCES cannot assume any responsibility for any incident resulting from allergies that are caused to the CLIENT following the consumption of food or drinks of third party suppliers during the experience.
The CLIENT authorizes LES PETITES EXPÉRIENCES to provide him, through the medical personnel of his choice, the usual medical assistance, transport and emergency medical services, in case of need. This consent does not impose any obligation on LES PETITES EXPÉRIENCES to provide such assistance, transport or services.
Finally, the CLIENT is fully responsible for his personal effects throughout the visit. LES PETITES EXPÉRIENCES is not able to claim responsibility for personal effects that may have been lost or stolen by a third party during the experience.
LATE ARRIVAL ON EXPERIENCE DAY
In the event that the CLIENT is up to 15 minutes late from the start time of the experience communicated by LES PETITES EXPÉRIENCES, The guide or companion of the experience reserves the right to change the itinerary at their discretion to complete the experience on time. The experience is automatically cancelled by LES PETITES EXPÉRIENCES without any option of refund, having or rescheduling if the CLIENT did not show up more than 15 minutes after the start time of the visit. In the case of a few latecomers in the group formed by the CLIENT, the guide or companion is not responsible for answering phone calls after the start of the experience, Provide missed information/food to participants joining after the start of the tour. This policy applies regardless of whether the CLIENT has informed LES PETITES EXPÉRIENCES or its representative of his delay or not.
CANCELLATION / REPROGRAMMING
We are very aware that life, especially when you’re travelling, is sometimes a little upset by the unexpected. Given this reality, but also our constraints, here is our cancellation policy.
If for any reason, the CLIENT must cancel his participation in the reserved experience, he must inform LES PETITES EXPÉRIENCES as soon as possible, by email to hello@lespetitesexperiences.com or by Whatsapp on +212 (0)6 43 899 535.
The cancellation of an entire booked experience is subject to the following conditions:
- Cancellation more than 7 days before the start of the experience: reprogramming of the experience, issue of a credit in the form of a gift card valid for 1 year, or refund of the price of the experience, from which the bank transfer fees are deducted.
- Cancellation between 48 hours and 7 days before the start of the experience: reprogramming possible (LES PETITES EXPÉRIENCES is obliged to propose another date, without being required to ensure the availability of the CLIENT, although we will obviously do our best to make it suitable for everyone) or issue of a credit in the form of a gift card valid for 1 year. No refund will be possible.
- Cancellation less than 48 hours before the start of the experience: no refund, credit or rescheduling will be possible, the amount paid by the CLIENT remains due to LES PETITES EXPÉRIENCES.
If you have cancellation insurance, any costs related to the cancellation will be reimbursed by your insurance, upon presentation of a valid proof.
In the case of cancellation of only a part of an experience participants, the same conditions apply but with a new calculation of prices for both participants in the initial experience and those who wish to reschedule an experience. Indeed, the experiences offered by LES PETITES EXPÉRIENCES are private: the price per person depends on the number of people participating in the experience. Therefore, in the case of cancellation of one or more participant(s), the rate for remaining participants will be recalculated according to the actual number of participants in the experience, and the CLIENT will only be refunded the difference between the amount already paid and the amount due once the recalculation of the tariff is made. Likewise, if the CLIENT wishes to reschedule an experience for a part of the participants, the initial price per person cannot be guaranteed, and the price of the rescheduled experience will be recalculated according to the number of participants.
For example, an experience costs 50€/person on a 4-person basis and 70€/person on a 2-person basis. A CLIENT has booked an experience for 4 people and therefore paid 200€. 2 participants are sick and wish to cancel their participation in the first experiment and reschedule another. The other 2 participants prefer to keep their participation in the initial experiment. The price will therefore be recalculated as follows: €140 (70 € x 2 people) for the experience maintained, and €140 (70 € x 2 people) for the reprogrammed experience. The CLIENT will therefore have to pay € 80 (2 x 40) extra to confirm the reprogramming of a 2 experience. If applicable, LES PETITES EXPÉRIENCES will apply the cancellation conditions above (refund or credit, depending on the cancellation deadline).
Only one rescheduling request is allowed per reservation.
In case of reimbursement, the CLIENT is obliged to communicate his RIB to LES PETITES EXPÉRIENCES. Note: credit/ gift cards are not refundable for any reason. In case of cancellation of an experience paid with a credit/gift card, the refund will be credited to the used gift card, without its validity date being changed.
LES PETITES EXPÉRIENCES reserves the right to cancel an experience at any time, in case of unforeseen circumstances, even if this situation is very unlikely to occur. In the event that LES PETITES EXPÉRIENCES is at the origin of the cancellation of an experience, the company is obliged to reimburse the CLIENT in full (without deduction of bank transfer fees) or to propose the reprogramming on another date at the choice of the CLIENT. The CLIENT will be free to decide whether he wants a refund or a rescheduling.
If there are heavy rains, winds or storms of any kind that could affect the experience, LES PETITES EXPÉRIENCES undertakes to try to contact the CLIENT by e-mail or telephone or any other means of contact available, to prevent it and decide together whether or not to continue the experiment. The CLIENT can also contact LES PETITES EXPÉRIENCES by email at hello@lespetitesexperiences.com or by phone/Whatsapp at +212 (0)6 53 899 535 if they are aware of bad weather conditions. In the case of a cancellation due to weather conditions making the experience impossible, LES PETITES EXPÉRIENCES will offer the CLIENT a rescheduling on the date chosen by the CLIENT, or a credit in the form of a 1 year gift card, or a full refund, according to his preference. The CLIENT must be equipped to face all weather conditions and all weather, such as cold/rain shoes, rain jackets and umbrellas if necessary. LES PETITES EXPÉRIENCES will offer options of reimbursement or to have or to reschedule to the CLIENT only in case of a visit cancelled due to climatic conditions making the experience impossible.
BY BOOKING ONE OR MORE EXPERIENCES WITH US, YOU AND/OR YOUR COMPANIONS AFFIRM TO HAVE FULLY UNDERSTOOD AND ACCEPTED THE PRESENT GENERAL CONDITIONS.
